Types of Bail Bonds
There are four different types of bail bonds that are applicable in the state of Oklahoma: property bail bonds, surety bonds, cash bail bonds, and personal recognizance.
Property Bail Bonds in Oklahoma
Property bail bonds in Oklahoma can often entail very complicated stipulations. The basic idea is that the defendant or the indemnitor—the person who is responsible for paying the bail amount on behalf of the defendant—can use a property of equal or greater value than the bail amount as collateral.
It may seem like a simple concept, but there are some logistical complications involved in the fine print. In some states, the law actually requires that the property value be double the amount of bail. The way most legislations define “property value” is slightly different than the standard definition, and this must be understood by whoever is offering their property as collateral. The property in question must be appraised by a professional real estate appraiser and it must be up to code.
According to Oklahoma state law, the value of the property is calculated at four times its actual market value, which constitutes the taxable property value multiplied by four. This is usually just 10% of the actual market value, which means that even multiplied by four, this amounts to far less than what the real property value is.
Surety Bail Bonds in Oklahoma
Surety bail bonds in Oklahoma are more straightforward. They are typically the preferred choice among most defendants and indemnitors. Surety bonds require the services of a fully licensed bail bond agent as they are considered unsecured bonds in the Oklahoma because they do not involve any upfront monetary payments or collateral offered to the court.
As the name implies, surety bonds are a written agreement and assurance to the court from the bail bond agent and the defendant that the defendant will not only comply with all stipulated court regulations in their case, but that the defendant will also appear at all forthcoming judicial proceedings. If the defendant fails to do so for any reason, then this results in bail bonds forfeiture, in which case the bail bond agent must pay the full amount of the bail immediately.
The defendant is usually required to pay a fee of 10% to 15% of the bail amount to the bail bond agent, which is typically enough of an incentive to comply with all court regulations. Most bail bonds agencies will implement a payment plan if the defendant cannot pay the full fee upfront.
Cash Bail Bonds in Oklahoma
In theory, a cash bail bond might seem like the easiest, most convenient, and most efficient option. Basically, the defendant or their indemnitor pays off the full bail amount to the court and, provided that the defendant adheres to all of the rules set out by the court and attends all mandatory court appearances, they will be reimbursed at the end of the trial. The problem is that, oftentimes, bail amounts can range anywhere from a few hundred dollars to thousands of dollars. It suffices to say that most people do not have these kinds of funds readily available to sacrifice at a moment’s notice, despite the fact that bail amounts are supposed to be reasonable according to the alleged crimes.
Personal Recognizance in Oklahoma
Personal recognizance bonds are usually only reserved for very minor crimes, such as misdemeanors. They do not require any upfront financial payments or collateral of any kind as they rely solely on the defendant promising that they will comply with all the rules of the court and be present at all scheduled hearings as part of their trial. All of this depends on the discretion of the judge presiding over the case. However, because the stipulations are so lenient towards the defendant, the punishments for even the most minor infractions are usually much harsher than for any other type of bail bond.
Federal Bail Bonds in Oklahoma
In Oklahoma, there is no such thing as a federal bail bond. Whether the defendant is incarcerated throughout the course of the trial depends upon the court’s position on the matter. If the court decides the defendant is liable to try to escape due diligence of a trial at any point, they can file a motion to the AUSA requesting the defendant be detained or held in the custody of the court. However, if the AUSA determines that the defendant should not be held in the court’s custody prior to sentencing, then the defendant will be released on a conditional basis. Under this circumstance, the defendant must agree to and sign an unsecured bond in the State of Oklahoma.
